1. Acceptance of Terms

By engaging Timeless Appliance Repair ("the Company," "we," "us," or "our") for services, or by using our website, you ("the Customer," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Timeless Appliance Repair, a business operating in Ontario, Canada.

2. Definitions

• Service: Appliance repair, diagnostic, and maintenance services provided by the Company
• Technician: A certified employee or contractor of the Company performing the service
• Appliance: Any household appliance brought to or accessed by the Company for repair
• Service Area: Markham, Richmond Hill, Thornhill, and surrounding regions
• Diagnostic Fee: The fee charged for assessing the issue with your appliance

3. Service Agreement

3.1 Scope of Services

We provide repair, diagnostic, and maintenance services for residential household appliances including but not limited to refrigerators, washing machines, dryers, dishwashers, ovens, stoves, microwaves, and freezers.

3.2 Service Request and Scheduling

Service requests can be made by phone, email, or through our online booking form. Appointments are scheduled based on technician availability. Same-day service is offered subject to availability.

3.3 Access Requirements

You agree to provide reasonable access to the appliance and a safe working environment for our technician. The technician reserves the right to refuse service if conditions are unsafe.

3.4 Diagnostic Process

All repair services begin with a professional diagnostic. The diagnostic fee is disclosed before the visit and may be waived or applied to the repair cost upon proceeding with the service.

3.5 Customer Authorization

No repair work will commence without your explicit authorization following the diagnostic. You will be informed of the estimated cost and expected outcome before any work begins.

3.6 Changes to Scope of Work

If additional issues are discovered during repair, we will notify you and obtain authorization before performing additional work.

4. Payment Terms

4.1 Pricing

Pricing is based on the type of service, parts required, and labour involved. We provide upfront, transparent pricing before commencing any repair work.

4.2 Payment Due

Payment is due upon completion of the service unless otherwise agreed in writing.

4.4 Late Payment

Unpaid balances may be subject to late fees of 1.5% per month (18% per annum) until paid in full. The Company reserves the right to use collection services for unpaid invoices.

4.5 Taxes

All prices are subject to applicable taxes (HST in Ontario at 13%) which will be clearly indicated on your invoice.

5. Warranty

5.1 90-Day Warranty

We provide a 90-day warranty on all repairs, covering both parts and labour, from the date of service completion.

5.2 Warranty Coverage

• Defects in workmanship
• Failure of parts installed by us during the warranty period
• Repeat issues caused by the original repair

5.3 Warranty Exclusions

• Damage caused by misuse, neglect, or accidents
• Issues unrelated to the original repair
• Damage from power surges, water damage, or natural disasters
• Modifications or repairs performed by third parties
• Normal wear and tear

5.4 Warranty Claims

To claim warranty service, contact us within the warranty period. Proof of original service (invoice or receipt) is required.

6. Cancellation and Rescheduling

7. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the cost of the service performed. We are not liable for:

• Indirect, consequential, or incidental damages
• Loss of food, beverages, or perishables in malfunctioning refrigerators or freezers
• Damage caused by pre-existing conditions of the appliance
• Loss of use during repair time
• Damages exceeding the amount paid for the service

8. Customer Responsibilities

You agree to:

• Provide accurate information about the appliance and its issues
• Disclose any prior repair attempts or modifications
• Ensure a safe working environment for our technician
• Be present or have an authorized representative present during the service (if required)
• Make timely payment for services rendered
• Follow our technician's recommendations regarding appliance use during and after repair

9. Refusal of Service

We reserve the right to refuse or terminate service if:

• The work environment is unsafe
• The customer is abusive or threatening to staff
• The appliance is beyond economical repair
• Required parts are unavailable
• Other reasonable cause exists

10. Property Damage

While we exercise care during all service calls, the Company is not responsible for damage caused by:

• Pre-existing conditions of the appliance or premises
• Customer's failure to disclose relevant information
• Acts beyond reasonable control

Any claims of damage caused by our technician must be reported within 24 hours of service.

11. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Timeless Appliance Repair and is protected by copyright laws. Unauthorized use is prohibited.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue to be valid and enforceable.
